• Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.

• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service. T

• EP means Elvisagram Performer

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Subscription registration for artists

Scope of service

Elvisagram is a website directory, connecting users with professional Musicians that provide a musical entertainment service. Artists can subscribe to our service for the purposes of advertising and lead generation. By using our service, the artist agrees to provide their contact details and follow the best practice procedures.

Apply for a 'EP subscription' . (Elvisagram Performer) by providing complete and truthful information.

Conditions for subscription registration

Registration of Subscription on our website is subject to the conditions outlined below. By registering, you agree to meet such conditions.

• It is not permitted to register subscription by bots or any other automated methods;
• You must register only one subscription, unless otherwise specified;
• Your subscription must not be shared with other persons unless otherwise specified.

The subscription is a 12 month agreement and includes

• Website listing, (An html link back to your site from Elvisagam.com. The link can be activated by a click within your assigned (EP Official Territory) on the EP Map.
• The site can be a website, social media page or landing page. The exact URL can be specified during the subscription signup process.
• Exclusivity on leads, Elvisagram will send you customer leads or booking requests which fall within the territory that you have been allocated.
• Permission to use our logo for promotion as EP within your designated territory only, unless otherwise stated.

Service provision

Elvisagram does not guarantee any quota of leads or booking requests will be supplied to the artist. Further, Elvisagram does not set any conversion target on the artist where leads have been provided.

Each artist can apply for up to 3 territories where they will be granted EP status, and have exclusivity on all leads generated by Elvisagram and partners. The territory is defined by geographical location such as City or County.

Elvisagram has the right to offer less than 3 territories, in the event there is high demand for EP status, or there are restrictions on service provision.

Our subscription fees may vary depending on the global location. See website for advertised rates. We will give reasonable written notice of at least 1 month to an artist, in the event that our fees will amended once an agreement is signed.

Product description

Prices, descriptions, and availability of products are detailed in the relevant sections of our website and may change without notice.

Although we strive for accuracy in presenting products on our website, representations (including graphics, images, colors, and sounds) are for reference only.

The specific characteristics of the chosen product are outlined during the application process.

Order submission

When you place an order, the following apply:

• submitting an order determines the contract conclusion and obligates you to pay the specified price, taxes, and any additional fees and expenses outlined on the order page;
• if the purchased product requires action from you, such as providing personal information or specific requests, submitting the order means you agree to cooperate accordingly;
• after submitting the order, you will receive a receipt confirming that the order has been received.

All communications regarding the purchasing process will be sent to the hello@elvisagram.com you provided.

Fees

During checkout and before order submission, you will see all charges, including any fees, taxes, and costs (including, where applicable, delivery costs).

On our website, prices are displayed including all applicable fees, taxes, and costs.

The cost for an artist subscription listing on Elvisagram is payable in your local currency.

• UK Customers - £ 60.00 per month. 4 x Quarterley payments, £180.00, OR 1 x *Annual 12 month payment of £600.00.
• USA Customers - $75.00 per month. 4 x Quarterley payments, $225.00 USD, OR 1 x *Annual 12 month payment of $795.00. USD.
• Canada Customers - $75.00 per month. 4 x Quarterley payments, $225.00 USD, OR 1 x *Annual 12 month payment of $795.00.
• EU Customers - €55.00 per month. 4 x Quarterley payments, €165.00, OR 1 x *Annual 12 month payment of €580.00.

Rest of World Customers - $75.00 per month. 4 x Quarterley payments, $225.00 USD, OR 1 x *Annual 12 month payment of $795.00. USD.

Methods of payment

Details about accepted payment methods are provided during the purchasing process.

Certain payment methods might have additional conditions or fees. In these cases, more information can be found in the related section of our website.

Payment methods include bank transfer, online providers such as Paypal or Stripe but not limited to.

Retention of product ownership

Until payment of the total purchase price is received by us, any products ordered will not become active on the website.

Delivery

Products are delivered electronically by activating your subscription on the website.

Upon delivery, please check the content and report any issues promptly using the contact details provided in this document or as outlined in the delivery note.

Subscriptions are available to the following countries: UK, USA, Rest of Europe, Worldwide

Delivery times are outlined on our website or during the purchasing process.

Your artist subscription will be activated within 5 days from the receipt of payment and the completed 'Code of Conduct' form.

Subscription Cancellation

It is possible to cancel your subscription plan with Elvisagram at anytime. There is a notice period of 1 complete month. Any time still remaining after the period of notice has expired will be refunded. For example,

UK Customers

if you make the first Quarterly payment of £180.00 and cancel the subscription within the first month, the last month will be refunded £60.00. The second month is the notice period. Or if you paid annually, £600.00 and cancel in month 6, you will receive a refund equal to 5 months of £250.00

After cancellation, your active listing and data will be removed from the website.

USA Customers

if you make the first Quarterly payment of $225.00 and cancel the subscription within the first month, the last month will be refunded $75.00. The second month is the notice period. Or if you paid annually, $795.00 and cancel in month 6, you will receive a refund equal to 5 months of $330.00

After cancellation, your active listing and data will be removed from the website.

EU Customers

if you make the first Quarterly payment of €165.00.and cancel the subscription within the first month, the last month will be refunded €55.00. The second month is the notice period. Or if you paid annually, €580.00 and cancel in month 6, you will receive a refund equal to 5 months of €240.00

After cancellation, your active listing and data will be removed from the website.

Canada Customers

if you make the first Quarterly payment of $225.00 and cancel the subscription within the first month, the last month will be refunded $75.00. The second month is the notice period. Or if you paid annually, $795.00 and cancel in month 6, you will receive a refund equal to 5 months of $330.00

After cancellation, your active listing and data will be removed from the website.

Rest of World Customers

if you make the first Quarterly payment of $225.00 and cancel the subscription within the first month, the last month will be refunded $75.00. The second month is the notice period. Or if you paid annually, $795.00 and cancel in month 6, you will receive a refund equal to 5 months of $330.00

After cancellation, your active listing and data will be removed from the website.

Refund charge

A refund transaction processing fee will be deducted from any refund balance owing to the artist. This covers our costs applied by third party payment providers. This charge will be applied in your local currency.

Subscription suspension and deletion

We reserve the right to suspend or delete any data relating to your subscription at any time and without notice, where there has been a violation of our terms. Examples include but are not limited to, 1, if complaints about the service provided by an EP are received, 2, Failing to represent the Elvisagram brand in a professional manner, 3, Insufficient or sub standard audio equipment to complete a peformance. Please refer to the 'Code of Conduct' document for more information that is signed upon joining the service.

Subscription renewal

Once the 12 month agreement has expired, you will have the opportunity to renew the agreement for a further 12 months at the advertised rate.

USER RIGHTS

Exercising your right of withdrawal

To withdraw from an agreement, you must inform us clearly of your decision. This can be done by contacting Elvisagam at the email address noted above.

Effects of withdrawal

If you correctly withdraw from an agreement we will reimburse you for any amount already paid, that is still outstanding following the 1 month notice period. See the section above (Subscription Cancellation)

Note that your Map listing on the Elvisgram website will be deactivated upon withdrawal. You will no longer receive any direct booking requests and you must remove the '(EP) Official logo' image from your marketing content in all formats (Online and Offline) with immediate effect.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
